Terms of Use

I, a user of the Nikahova Service, confirm that, prior to registration and commencement of use of the Service, I have been given the opportunity to review the terms governing its use.

I hereby freely and knowingly confirm the following:

1. User Agreement. I have read the Nikahova User Agreement, understand its contents, accept its terms in full, and agree to comply with them when using the Service.

2. User-Generated Content Rules. I have read the Nikahova User-Generated Content Posting and Moderation Rules (UGC Policy), accept the requirements established therein with respect to Profiles, photographs, videos, posts, messages, and other Content, and agree to comply with them.

3. Privacy Policy. I confirm that, prior to commencing use of Nikahova, I have been given the opportunity to review the Nikahova Privacy Policy, which contains information about the personal data processed by the Controller, the purposes and lawful bases of such processing, the recipients to whom such data may be transferred, where and for how long such data may be stored, and my rights in relation to personal data.

Reviewing the Privacy Policy does not, in itself, replace any separate consent to the processing of personal data where such consent is required by applicable law.

4. Age. I confirm that I am at least 18 years of age at the time of registration. I understand that persons under the age of 18 are prohibited from using Nikahova.

I understand that providing false information about my age constitutes a violation of the Nikahova Terms of Use and may result in restricted access, suspension, or deletion of my Account.

5. Purpose of the Service. I understand that Nikahova is a matchmaking service for adults, intended to help Users search for a potential husband or wife for the purpose of starting a family and entering into marriage (nikah).

I understand that Nikahova provides the technical means for Users to search for and communicate with one another, but is not a party to the relationships between Users, does not enter into a marriage or nikah on their behalf, does not make decisions for Users regarding the choice of a husband or wife, and does not guarantee an introduction, mutual attraction, continued communication, an in-person meeting, or marriage.

6. Accuracy of Information. I agree to provide accurate information about myself and not to impersonate another person, use another person’s photographs or videos as my own, or knowingly provide false information that may materially affect another User’s decision to initiate or continue an acquaintance or communication.

7. Compliance with Communication Rules. I agree to use Nikahova lawfully and in good faith, respect the rights of other Users, and not use the Service for threats, harassment, bullying, blackmail, fraud, unlawful discrimination, dissemination of prohibited Content, spam, or any other activity prohibited by the User Agreement, UGC Policy, or applicable law.

8. Content. By uploading photographs, videos, texts, posts, and other Content to Nikahova, I confirm that I have the necessary rights to use and post such Content.

I understand that I am prohibited from posting, without a lawful basis, photographs of other persons, personal data, private communications, intimate materials, or other Content that infringes the rights of third parties.

9. Personal Safety. I understand that the Controller cannot guarantee the accuracy of every statement made by another User and does not conduct comprehensive background, financial, medical, religious, or other checks on every registered person.

I independently decide whether to continue communicating, disclose additional information about myself, meet another User in person, or enter into marriage.

10. Privacy of Other Users. I agree not to use information obtained through Nikahova for purposes unrelated to the lawful use of the Service and not to disseminate another person’s Profile, photographs, videos, private communications, or sensitive information without an appropriate lawful basis.

I understand that taking a screenshot or having the technical ability to save information made available to me does not give me the right to unlawfully disseminate such information further.

11. Moderation. I have been informed that Nikahova moderates User Content in accordance with the User Agreement, UGC Policy, and Privacy Policy.

Automated technical means and manual moderation may be used to identify potentially prohibited Content.

12. Moderation of Media in Private Messages. I have been separately informed that photographs and videos sent through Nikahova private chats may be automatically reviewed by the security and moderation system.

If the automated system detects indications of a possible violation, the relevant photograph or video may automatically be placed in a restricted queue for review by an authorized moderator, including without a prior complaint from another User.

I am aware of this aspect of Nikahova functionality before I begin using the functions for exchanging such materials.

13. Complaints and Safety Measures. I understand that, in the event of a violation of the rules, the Controller may, in the circumstances provided for by the User Agreement, remove or restrict Content, issue a warning to the User, restrict certain functions, temporarily suspend the Account, block it, or delete it.

I am given the opportunity to contact support regarding an action taken against me in accordance with the procedure set out in the User Agreement.

14. Paid Features. I understand that certain Nikahova features may be provided for a fee.

The price, duration, scope of the paid feature, subscription terms, and automatic renewal terms, where applicable, are provided to me before I make a purchase.

Purchases made through the mobile application are processed through the relevant Apple App Store or Google Play mechanisms, while payments available through the website may be processed through the payment provider used on the website.

When making a specific purchase, I separately confirm the applicable terms before payment.

15. Separate Personal Data Consents. This acceptance of the Nikahova Terms of Use does not replace or combine the separate consents to the processing of personal data required by law.

Where necessary, I am separately provided with:

Consent to the Processing of Personal Data;

Consent to the Processing of Special Categories of Personal Data;

Consent to the Processing of Personal Data Authorized by the Data Subject for Dissemination;

Consent to Receive Advertising and Marketing Communications, where such consent is required.

16. Sensitive Information. I understand that the Nikahova Profile may allow the voluntary provision of information concerning religious beliefs and religious practices, nationality, family circumstances, and other sensitive characteristics.

17. Data Displayed to Other Users. I understand that providing information to the Controller and displaying the relevant information to other Users constitute separate processing operations.

Authorization to display and disseminate the relevant categories of my personal data is provided separately where required by law and in accordance with the Nikahova settings.

18. Service and Marketing Notifications. I understand that Nikahova may send necessary service notifications relating to Account security, messages, payments, subscriptions, and operation of the Service.

Advertising and marketing communications shall not be deemed automatically accepted as a result of this acceptance. Where applicable law requires separate consent to receive such communications, such consent shall be requested separately.

19. Changes to Documents. I understand that the User Agreement, UGC Policy, and other terms governing the operation of Nikahova may be amended in accordance with the procedures set out in the relevant documents and applicable law.

Where an amendment requires my renewed consent or confirmation, such consent or confirmation must be obtained separately.

20. Final Confirmation. By clicking the relevant button or checking the relevant checkbox, I confirm that I am at least 18 years of age; that, prior to registration, I have had the opportunity to review the User Agreement, Privacy Policy, and UGC Policy; that I accept the User Agreement and UGC Policy; that I understand the purpose of Nikahova and the principal rules governing use of the Service; that I understand that automated and manual moderation may be carried out; that I understand that separate consents relating to personal data and marketing are provided separately; and that I express my decision by means of an independent affirmative action.

The Controller may record the User ID, the date and time of acceptance, the version of the User Agreement and UGC Policy, the version of this confirmation, and the fact of the User’s affirmative action for the purposes of evidencing the conclusion of the agreement and compliance with applicable legal requirements.
